Learning Connected Ltd Terms and Conditions

In the following agreement Learning Connected Ltd is referred to as ‘us’, ‘our’ or ‘we’ and the learner, parent/guardian, or any other person/body responsible for booking and paying for the course is referred to as ‘you’ or ‘your’.

Through signing up to our course(s) you agree to the following terms and conditions.

1. Parental/Legal Guardian Permission
Any learner(s) under the age of 18 signing up or being registered for any of our courses must have parental or legal guardian permission to do so.

2.  Application and Learner Information Form
By registering, the Learner acknowledges s/he has read this Contract and that s/he will be bound by this Contract if s/he is a) notified of her/his Acceptance by Learning Connected Ltd and b) s/he pays the full fees for the Online Entrepreneurship Course.
i. The Learner must be aged between 14-17 at the start of the Online Entrepreneurship Course.
ii. The Learner must be able to speak, understand and read English to an Upper Intermediate/Advanced English level. The Learner’s English language level must be at least B2 according to the Common European Framework Level. If Learning Connected Ltd determines at its sole discretion that the Learner’s English proficiency is not at this level, Learning Connected Ltd  reserves the right to remove the Learner from the Online Entrepreneurship Course without refund.

3. Acceptance
By submitting an Application, this does not constitute Acceptance. Any Acceptance is solely at the discretion of Learning Connected Ltd subject to reviewing the Learner’s Application. Learning Connected Ltd  may request additional information before making a decision regarding Acceptance.
ii. The Learner’s place is not confirmed until s/he has paid the full fees for the Online Entrepreneurship Course.
iii. Learning Connected Ltd  reserves the right to withdraw any offer that is made to the Learner, or terminate the Contract if the Application is inaccurate or incomplete.

4. Payment
i. Fees are inclusive of VAT. 
ii. Payment must be made in pounds sterling via Stripe.
iii. The Online Entrepreneurship Course fees are not refundable in any circumstance except in accordance with clause 7(i).

5. Change of Platform and Educators
We reserve the right to change the advertised educators at our discretion. We also reserve the right to change the advertised platform giving reasonable notice to attending Learners.

6. Asking for a Learner to Leave
If an educator feels that a Learner’s behaviour is not acceptable or their behaviour is disrupting the class, we reserve the right to ask them to leave without refund.

7. Refund and Cancellations
i. The Learner has the right to cancel this Contract and receive a refund of her/his Online Entrepreneurship Course fees net of any bank charges, credit card fees or foreign exchange losses, if the cancellation is made within fourteen calendar days after entering in to the Contract unless the Commencement Date starts before the fourteen calendar days has expired (in which case the Learner will be refunded the Online Entrepreneurship Course fees minus any charges Learning Connected Ltd  has incurred as a result of, for example, hiring educators).
ii.  The refund payment will be repaid to the Learner within 30 days following cancellation.
iii.  If the Learner wishes to cancel this Contract in accordance with clause 7(i), Learning Connected Ltd must be notified in writing by email to the course administrator to: [email protected]. 
vi. If the Learner  cancels other than in accordance with clause 7 (i) and does not give notice in accordance with clause 5 (iv), then s/he shall not be entitled to a refund (including, for example, cancellation as a result of illness before or during the Online Entrepreneurship Course), nor shall the Learner  be entitled to carry forward the fees to another year, nor shall the Learner  be entitled to transfer their place or funds paid to another Learner. 
We will make the reimbursement using the means of payment that you used for the initial transaction.
We reserve the right to review this refund policy on a case by case basis in extreme circumstances.

8. Learner Agreement
 The Learner agrees to:
i. Behave considerably, responsibly and co-operatively towards anyone involved with Learning Connected Ltd , including fellow learners, educators and staff, and, for Summer School learners.
ii. Not publish any material by any medium relating to Learning Connected Ltd , its staff, learners, facilities or any other person or body Learning Connected Ltd  has a relationship with without Learning Connected Ltd’s written permission.
iii. Not give interviews or statements to any form of media outlet (including social media) in relation to Learning Connected Ltd  unless given written permission to do so by Learning Connected Ltd. 
iv.  Withdraw any material given to any form of media outlet (including social media) where permission was not given by Learning Connected Ltd. 

9. Complaints Procedure
We hope and intend that cause for complaints will be infrequent. We are committed to maintaining an effective system for managing and reviewing concerns raised, and for resolving them swiftly. We aim to make clear to Learners how matters should be raised, and how they can expect matters to be treated. Records of all complaints will be retained for a period of 10 years.
We encourage general areas of concern about provision affecting Learners as a whole to be raised through student feedback channels, such as questionnaires.

Level one
Learning Connected staff will discuss the matter informally with the parent/carer concerned and aim to reach a satisfactory resolution.
Complaints about an individual staff member:
If appropriate the parent/carer will be encouraged to discuss the matter with staff concerned.
If the parent feels that this is not appropriate, the matter will be discussed with Learning Connected staff, who will then discuss the complaint with the individual concerned and try to reach a satisfactory resolution.

Level two
If it is impossible to reach a satisfactory resolution to the complaint through informal discussion, the parent or carer should put their complaint in writing to the Learning Connected HQ, FAO: F Danmeri. The complaint will then proceed as follows:
  • Acknowledge receipt of the letter within 7 days and investigate the matter within 28 days.
  • Send a full response in writing, to all relevant parties, including details of any recommended changes to be made to the camp’s practices or policies as a result of the complaint.
  • Meet relevant parties to discuss Learning Connected’s response to the complaint, either together or on an individual basis.

If child protection issues are raised, the situation will be referred to the Safeguarding Officer, who will then contact Social Care and follow the procedures of the Safeguarding Children Policy. If a criminal act may have been committed, the police will be contacted.

10. Data Protection
i.  Learning Connected Ltd  will comply with the General Data Protection Regulation (2016/679) and the Data Protection Act 2018 (the “Data Protection Legislation”). 

11. Force Majeure
i. Learning Connected Ltd shall not be liable for any failure, delay or part-performance in performing their obligations where such failure or delay results from any cause that is beyond their reasonable control. Such causes include, but are not limited to: power failure, Internet Service Provider failure, third party service or facility withdrawal, industrial action, civil unrest, fire, flood, storms, earthquakes, outbreak of contagious or other notifiable human or animal infection, disease or condition, air traffic disruption, acts of terrorism, acts of war, governmental action or changes in legislation/regulation, any direction of a competent local or national authority (or fear of such), or any other event that is beyond the control of Learning Connected Ltd . This also includes situations where any buildings or schools are closed, through no fault of Learning Connected Ltd , and the Summer School cannot be provided at the pre-arranged location.
ii. If a Force Majeure Event or disruption from such an event occurs, Learning Connected Ltd  may terminate this Contract by written notice to the Learner. 
iii. Should the Programme be cancelled, postponed or otherwise adversely impacted as a result of a Force Majeure Event, there shall be no refunds for payments already received by Learning Connected Ltd . If economically and administratively viable for Learning Connected Ltd  to do so, Learning Connected Ltd  will make all reasonable efforts to offer a place at a future Online Entrepreneurship Course  to the Learner, subject to availability, and shall not be liable for any additional expenses the Learner may incur (including, but not limited to, travel or accommodation) because of cancellation or postponement of the Programme and in attending a future Programme. Learning Connected Ltd  shall not be required to offer such an alternative place, does not guarantee that it will do so, and shall not be required to offer any refund or monetary compensation to the Learner in such cases. For the avoidance of doubt, the occurrence of a Force Majeure Event shall in no circumstances place any requirement on Learning Connected Ltd  to make any form of reimbursement, compensation or refund.

12. Promotional Activities
i.  Learning Connected Ltd staff members may ask the Learner to participate in photographs, videos or other promotional activities during the Online Entrepreneurship Programme, for use in Learning Connected Ltd ’s future publicity. The Learner should advise Learning Connected Ltd in writing before the Programme if s/he would prefer not to participate in these activities and unless otherwise instructed in writing, Learning Connected Ltd  may use these images for its business use and promotional activities on an ongoing basis.
ii.  At the end of the Online Entrepreneurship Programme Learning Connected Ltd  will ask the Learner  to fill in an evaluation questionnaire. Learning Connected Ltd  may use statistics and quotes from these to promote future Programmes, and may state  only the Learner’s first name and city next to these quotes. The Learner should advise Learning Connected Ltd  in writing if s/he would prefer for Learning Connected Ltd  not to use this information in future publicity.

13. General
i.  Nothing in this Contract shall be construed as creating a partnership with the Learner.
ii.  The Learner  may not subcontract any rights under this contract to another person or company without the consent of Learning Connected Ltd. 
iii.  Learning Connected Ltd  makes every effort to provide an accurate description of the Online Entrepreneurship Course, but can make no guarantee about the content or structure, which may change.
iv.  Learning Connected Ltd  reserves the right to cancel the Online Entrepreneurship Course (for reasons including, but not limited to, insufficient numbers of learners signed up for the course), in which case Learning Connected Ltd  will make every effort to transfer the Learner  to another programme.
vi. Learning Connected Ltd  reserves the right to modify or cancel the Online Entrepreneurship Course, and to make alterations to the programme, terms, rules, policies, courses and educators at any] time before or during the Programme without the Learner’s consent. Learning Connected Ltd  shall not be held responsible for any inconvenience caused and extra expenses incurred.

14. Jurisdiction 

Your contract with Learning Connected Ltd  and any dispute arising from it (including non contractual disputes) shall be governed by the laws of England and Wales and shall be subject to the exclusive jurisdiction of the English Courts.
